1 A) Clearing the Fog in Condominium Insurance
Presenters: Doug Lyall (HUB International) and Tony Reed (BFL Canada)
The thrust of the upcoming changes in insurance was to bring more clarity for both corporations and owners when dealing with potential insurable losses. We will review what work is now in store for boards and managers to ensure the corporation is ready when the legislation is enforced as of January 1, 2020.
- What is “absolute liability” and how does that affect owners and the corporation when it comes to deductible claims? How has the responsibility for coverage and repairs changed and what information needs to be communicated to the owners so they are properly covered?
- The introduction of the “standard insurable unit description” will help clarify the responsibility to insure and repair but how do corporations decide on the description and then get approval? Do you need more than one class of description?
Fidelity bonding will now be required for all corporations to cover board or manager financial malfeasance. Learn how to establish the minimum bonding limits and what may be required of the corporation to ensure that their coverage applies.
1 B) Document Do’s and Don’ts – Distribution, Retention & Fees SOLD OUT

One of the hot button topics during the government’s public consultations, the distribution of corporation documents and what (if anything) should be charged is now going to be addressed. It may not be ideal but it is what we have to work with for the time being. We will dive into the document details as follows:
- Additional documents that have been added for public disclosure upon request
- What corporations can and cannot charge for and the new fee limits
- Notification requirements for a variety of documents
- How documents can be transmitted and what boards should focus on to lower costs and save time.
- How long records must be retained and in what format they can be kept.
1 C) Tackling Human Rights Issues in Condos
Presenters: Melissa L. Stappler (Willis Law) and Heidi Besuijen (Reynolds Mirth Richards & Farmer LLP)
Recent case law has confirmed that the Alberta Human Rights Act applies to condominium corporations and protects members of the public against discrimination on a number of protected grounds. Boards are increasingly being faced with requests and/or complaints on
issues such as service animals, wheelchair access, etc. and need to understand how best to investigate and resolve if necessary.
- Get an overview of Alberta’s human rights legislation and what areas can be applied in a condominium setting
- How does the corporation’s “duty to accommodate” apply and to what extent must they comply?
- Learn best practices on how to respond and investigate when a human rights complaint is received and review recent decisions of the AHRC for context
- Confirm the steps you need to take if your condo currently has an age restriction following last year’s changes.

2 A) The Future of your AGM is Burdensome – Dealing with the New Reality
Presenter: Victoria Archer (Gledhill Larocque)
If there is one area that has boards and managers shaking their heads the most regarding the upcoming legislation it’s the new regulations regarding General Meetings. While some improvements have been made, there is no doubt that the amount of time and detail required to complete all the requirements before, during and after the meeting has substantially increased. We will discuss best practices to assist with:
- Additional notification requirements including documents, outlines and deadlines
- Owner agenda items and how best to work with owners to streamline the process for all
- The new voting regime including how voting rights will be assigned and votes tabulated
- How proxies must be outlined, restrictions of use and who can hold them
- How minutes must be recorded and distributed following the meeting
2 B) Reserve Fund Plan and Annual Report Workshop SOLD OUT
Presenters: Shantel Kalakalo (Wade Engineering) and Alex Zovighian (KDM Management)
Although boards for the most part have little trouble hiring a provider to complete a reserve fund study and provide the report for approval, a number struggle with their responsibility in providing an updated plan for the owners. In addition, a revised annual report is being introduced that requires additional information so both the board and owners can be on the same page when it comes to how the corporation will be dealing with its capital assets.
In this hands-on workshop, attendees will have the opportunity to review how a reserve fund plan should be constructed and reviewed on an annual basis and parameters to consider when there may be a need to alter the information supplied by the provider. We will also create a template for corporations to use for the revised annual report produced in advance of your AGM.
As a bonus, we will identify the other reserve fund changes that have been included in the upcoming legislation.
2 C) Managers are from Mars, Boards are from Venus – Best Practices for a Healthy Relationship
Presenters: Jamie Shima (Pivotal Property Management), Darcie Lee Rea (Hallmark Management), Leslie Johnson (Westcliffe Arms), Mary Schweitzer and Joyce Kropiniski (Foxhaven Grande)
The critical relationship between the board and manager can turn water into wine when it works but can then turn it back to sour milk when it doesn’t. The reality is that when you mix in a volunteer board who have multiple other priorities with a manager who has multiple other clients it takes a lot of work from both sides to make the relationship blossom. Whether it is due to a lack of processes, clash of personalities, divergent perspectives or uncertainty of costs, the board and manager are required to resolve the issue for the betterment of the corporation.
Our panel will provide some anecdotal examples of how important the pillars of trust, transparency, communication and accountability are and the challenges that can erupt when things fall between the cracks. They will also provide some direction on questions from the audience who may be challenged with their own issues in this interactive session.

3 A) The New Governance Guidelines – Rules and Bylaws SOLD OUT

In addition to the Act and Regulation, condominiums have their own unique list of bylaws, rules and or policies. Due to the changes in legislation, there is a strong likelihood that many revisions will be required to ensure your governing documents are still pertinent and not in contravention.
Key points of discussion with practical examples and solutions include the following topics:
- Common bylaws that likely will be in contravention and how they can be dealt with
- The introduction of rules – what they can and cannot cover, how they are approved and how they can be repealed
- How to ensure existing policies/rules can still be enforced
- When ordinary or special resolutions are required
3 B) Not So Fast with Fines and Sanctions – A Process Primer SOLD OUT
Presenter: Todd Shipley (Reynolds Mirth Richards & Farmer LLP)
One of the areas where additional clarification has been welcomed in the legislation is in regards to fines and sanctions. With the additional details provided however, boards must be aware and follow through with the new processes that are outlined in the regulations.
This session will outline what is changing and best practices to follow to ensure compliance.
- What is the difference between a fine and a sanction?
- The updated notification process including proposed sanctions, what details must be included in the notice, service of notice and owners ability to respond
- Proper record keeping and the limits of boards to delegate responsibility
- New limits for initial, subsequent and cumulative monetary sanctions
3 C) Haste Makes Waste: The Benefits of Building Investigation Explored
Presenters: Justin Tudor (Keller Engineering), Marla Snoddon (Entuitive Corporation) and Bereket Alazar (Morrison Hershfield)

The edge-of-your seat excitement that only a building restoration project can deliver is often tied to the unknown conditions behind the walls, underneath the membrane, and hidden in the concrete. Join our panel of engineers as they review the cost effectiveness of different types of pre-construction assessments.
Discussions will include: when should exploratory investigation occur, the limits of visual investigations, the use of technology in non-destructive testing, what a reserve fund study field review should identify, and how that’s different from a specific component or element investigation, and more.

For those of you who have not had the pleasure of attending a previous legal panel, it is always interesting to hear the different perspectives each of them bring along with their expertise.
This year each lawyer will introduce their own “soap box item” on a point they feel needs to be emphasized to the condominium community. The Q & A section will then open up where the audience will have the opportunity to ask their own general questions, whether it is dealing with any aspect of the legislation, updates on Cannabis concerns, human rights matters or general governance direction.

The upcoming changes in the legislation are significant and it is important for condo owners to understand the key changes that will have the most impact to them.
